Terms of Service
These Terms of Service (the “Terms”) form a binding agreement between you and Navicore (“we”, “us”, the “Operator”), an independent project based in Ukraine, governing your use of the Navicore mobile application and all related services (the “App”). By installing, signing in, or otherwise using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. The App is intended for personal, non-commercial use.
2. Your account
- You are responsible for keeping your sign-in credentials confidential.
- You agree to provide accurate registration information and to keep it up to date.
- You must not share your account, sell access to it, or impersonate another person.
- One person — one account. Creating multiple accounts to bypass limits, farm rewards, or evade moderation is prohibited.
3. Licence to use the App
We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the App for your personal, non-commercial use, on devices you own or control. All rights not expressly granted are reserved.
4. Subscriptions and payments
- The App offers an auto-renewing Premium subscription at $4.99 / month or $39.99 / year (prices may vary by region; see the in-App paywall for current pricing).
- The annual plan includes a one-time 7-day free trial. The trial converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.
- Payment is charged to your Apple ID on confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period.
- Refunds are processed by Apple under its refund policy. We do not have the ability to issue refunds directly.
- Free-trial eligibility is governed by Apple's rules; in particular, you may be eligible only once per Apple ID / family.
5. Free tier and ads
Without a subscription, the App provides limited features (e.g. capped questions per day, restricted lifelines). To unlock additional features without subscribing you may opt to watch rewarded advertisements. Watching an ad is voluntary; you can always subscribe instead. Ads are served by Google AdMob; on iOS, whether they are personalized depends on your App Tracking Transparency choice.
6. User-generated content (chat)
The App includes rank-based chat rooms. By posting a message you agree:
- Not to post unlawful, harassing, hateful, sexually explicit, or threatening content.
- Not to spam, promote unrelated products, or share personal information of other users.
- Not to share copyrighted material you don’t have rights to.
- That moderators may delete messages, mute, or ban accounts that violate these rules.
- That you grant us a non-exclusive, royalty-free licence to host, display, and back up the messages you post, solely for the purpose of operating the chat feature.
7. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except to the limited extent permitted by mandatory law.
- Bypass or attempt to bypass anti-fraud mechanisms (App Attest, rate limiting, ad-reward verification, attestation challenges).
- Use bots, scripts, modified clients, jailbroken devices, or automated tools to interact with the App.
- Interfere with the operation of the App or any servers or networks connected to it.
- Use the App to violate any applicable law or regulation.
We may, at our sole discretion, suspend or terminate accounts that violate this section. Repeated or severe violations may also be reported to the relevant authorities.
8. Educational content disclaimer
The App contains study materials, sample questions, and AI-generated explanations intended for personal preparation. While we make reasonable efforts to keep content accurate and up to date, the App is provided for educational purposes only. Do not rely solely on the App for safety-critical decisions, professional certification, or operational maritime navigation. Always verify critical information with official rule books, regulations, and certified instructors. We are not liable for any consequences of relying on App content as a substitute for professional or official sources.
9. Intellectual property
The App — including its source code, design, branding, illustrations, curated question banks, and AI-generated explanations — is owned by the Operator or licensed to us. You may not copy, modify, distribute, sell, or create derivative works of any part of the App without our prior written permission. Trademarks of third parties (Apple, Google, AdMob, RevenueCat, Supabase, Sentry, Cloudflare, Resend) belong to their respective owners.
10. Privacy
Our processing of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Termination
- You may stop using the App and delete your account at any time via Profile → Settings → Delete account.
- We may suspend or terminate your access if you breach these Terms, abuse the service, or if we are required to do so by law.
- Sections that by their nature should survive termination (Intellectual property, Disclaimers, Limitation of liability, Governing law) will continue to apply.
12. Disclaimer of warranties
The App is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties — express, implied, statutory or otherwise — including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
13. Limitation of liability
To the maximum extent permitted by applicable law, in no event will the Operator be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the App. Our total cumulative liability for any claim arising out of or related to the App will not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months preceding the claim, or (b) USD 100. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability will be limited to the maximum extent permitted by law.
14. Indemnity
You agree to indemnify and hold the Operator harmless from any claim, demand, loss, or damages, including reasonable attorneys’ fees, made by any third party arising out of your breach of these Terms, your misuse of the App, or your violation of any law or the rights of a third party.
15. Governing law and jurisdiction
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws provisions. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of Odesa, Ukraine. If you are a consumer residing in the European Economic Area, you may also rely on the mandatory consumer-protection rules of the EU member state in which you reside.
16. Apple-specific terms
You acknowledge that these Terms are between you and the Operator, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for product warranties or third-party claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by in-App notice or, if you have given permission, via push notification. Continued use of the App after the update constitutes acceptance of the updated Terms. The effective date at the top of this page reflects the most recent version.
